This document outlines the terms of service for Franstorm CRM, a software developed and maintained by Franstorm, Inc. By using the software, you agree to abide by these terms.
1. Acceptance of Terms
By accessing or using Franstorm CRM, you accept these Terms of Service. If you disagree with any part of the terms, you should not use the service.
2. Modifications to Terms
Franstorm reserves the right to modify or update these terms at any time. Continued use of the service after changes are made constitutes acceptance of the updated terms.
3. Services Provided
Franstorm CRM is a software solution designed for managing customer relationships, franchise operations, sales, and marketing activities. Specific features include lead tracking, analytics, and automation tools.
4. Account Registration
To use the Service, you must create an account, providing accurate and complete information. You are responsible for maintaining the security of your account and password.
5. Subscription Plans
The Service operates under a subscription model with different tiers. You agree to pay all fees and charges associated with your selected subscription plan.
6. Payment and Billing
Payments are required at the beginning of the subscription period. Non-payment may result in suspension or termination of service. Franstorm reserves the right to modify pricing with notice.
7. Refund Policy
No Refunds. Customer pays FranstormCRM all fees associated with its Service Plan or use of the Services and the Products. Customer’s payments are not fully or partially refundable.
8. User Conduct
You agree to use the Service for lawful purposes only and to comply with all applicable laws and regulations. Prohibited actions include, but are not limited to, unauthorized access, data scraping, or spam activities.
9. Prohibited Uses
You may not use the Service to: – Transmit harmful or malicious software – Engage in illegal activities – Infringe on any intellectual property rights
Franstorm respects your privacy and handles your data in accordance with its Privacy Policy. You are responsible for any data you provide or input into the system.
Franstorm employs industry-standard security practices to protect user data but cannot guarantee absolute security. Users must safeguard their credentials.
Franstorm retains ownership of all intellectual property rights associated with the Service, including software, features, and design elements. Unauthorized use or distribution of these materials is strictly prohibited.
Franstorm CRM may integrate with third-party services. Use of these services is subject to their respective terms, and Franstorm is not responsible for any issues that arise from their use.
Upon subscribing, users are granted a limited, non-transferable, and non-exclusive license to use the CRM software as per the terms outlined herein.
Franstorm aims for 99.9% uptime but does not guarantee uninterrupted service. Downtime may occur due to maintenance, upgrades, or unforeseen technical issues.
Franstorm reserves the right to suspend or terminate your access to the Service for violations of these terms, non-payment, or misuse of the platform without notice.
While Franstorm implements regular backups, you are responsible for maintaining copies of important data. Franstorm will not be liable for any data loss.
Franstorm provides the Service “as-is” and makes no warranties regarding its performance, accuracy, or reliability. All warranties, implied or explicit, are disclaimed to the fullest extent allowed by law.
In no event will Franstorm be liable for direct, indirect, incidental, or consequential damages arising from the use or inability to use the Service.
You agree to indemnify and hold Franstorm harmless from any claims, losses, or damages resulting from your use of the Service, violation of these terms, or infringement of any rights.
Most disputes, differences, or controversies of whatever nature between the parties, howsoever arising under, out of or in relation to this Agreement can be resolved amicably without resorting to legal action. If a dispute arises, you should first submit us written notification at contact@franstorm.com and state a description of the dispute and any other necessary information (“Notice of Dispute”). The parties shall make good faith efforts to resolve the dispute by mutual agreement within thirty-five (35) business days following receipt of the Notice of Dispute before proceeding to any legal action.
These Terms of Service are governed by and construed in accordance with the laws of the State of North Carolina, excluding conflict of law principles.
Franstorm is not responsible for any failure to perform due to causes beyond its reasonable control, including acts of nature, war, or technical failures.
If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
